Introduction

By submitting an advertisement to the FlogYourBike.com website you are deemed to have accepted the terms and conditions laid out here. These terms and conditions and the contract of which they form part shall be governed by English law. All references to the customer refer to the user applying to place and advertisement for a vehicle on the FlogYourBike.com website. All references to the web site refer to the FlogYourBike.com internet site. This service offers the facility to compose and place and advertisement for a new or used pedal bicycle or related accessory on the FlogYourBike web site.

Duration

Advertisers are offered the option of placing a standard advertisement for a period of 6 months from the date of first publication on the web site, advertisers can also choose to place a premium advertisement for 6 months on the web site.

Price

The price of a standard advertisement for private advertisers on FlogYourBike.com is £1.00 whilst premium advertisements are available at £2.00.

Processing your Advertisement

Only one bicycle may be featured in each advertisement although you may include as many accessories as you like. The advertising copy you supply must be legal, decent, honest and truthful and must comply with the British code of Advertising. FlogYourBike may amend the advertisement to ensure compliance with these requirements. FlogYourBike is not able to verify the truthfulness of any statements (including the authenticity of photographs) made by a customer in the advertisement copy. Accordingly the customer shall be responsible for any losses, expenses or cost incurred by FlogYourBike by an untrue statement or inaccurate photograph supplied by the customer. In order to meet the technical and production requirements of the web site, FlogYourBike reserves the right to edit, alter or amend the copy or photograph supplied buy the customer. In the event that FlogYourBike is unable to accept an advertisement for any reason, we will attempt to inform the customer of this if at all possible. In the event that we reject the advertisement, no charge will be incurred by the customer. No contract will be deemed to exist between the customer and FlogYourBike.com until the advertisement has been accepted for publication on the web site.

The copyright in all advertisements (including text and photographs) shall be owned by us and you hereby assign all such copyright to us.

Payment

Payment for on-line advertisements by private advertisers are made via PayPal Express.

Fulfilment Timing

Advertisements supplied on-line will be processed immediately and published on the site the same working day.

How to cancel an Advertisement

The publication of an advertisement can be cancelled to avoid unwanted response. To do this log in to your user menu and selecting the option 'View Current/Past Adverts.' Here you can see all the adverts you have placed and remove them using the options on the right.

How and when will your order be confirmed

As soon as an advertisement has been accepted for placement, a confirmation email will be sent to the advertiser explaining that the advertisement has gone live on the site. In the event that the advertisement has been rejected, FlogYourBike will send an email to the customer explaining why the advertisement has been rejected.

How can you change and delete your advertisement once it is live

An advertisement can be deleted or altered by logging in to your user menu and selecting the option 'View Current/Past Adverts.' Here you can see all the adverts you have placed and edit/remove them using the options on the right.

Liability

FlogYourBike will require to carry out routine maintenance and service of its servers and equipment. Whilst FlogYourBike seeks to keep disruption to a minimum, it does not guarantee that the advertisement will be continuously available on-line for the duration of the booked advertising period. Where the advertisement does not appear on the web site despite confirmation being sent to the advertiser, the customer will be entitled to additional free week’s carriage or a refund of the advertisement price, unless the omission, cancellation or mismatch was caused by unforeseen circumstance beyond the reasonable control of FlogYourBike or breach of contract by the customer. FlogYourBike’s liability for breach of contract or negligence shall not exceed an amount equal to the price of the advertisement; provided that nothing in this clause shall limit FlogYourBike’s liability for death or personal injury cause by our negligence or that of our service agents. English law shall govern the terms and conditions of this contract of which they form a part.

Privacy Policy

FlogYourBike.com values your privacy. We will only use any information we collect about you lawfully and in accordance with the Data Protection act 1998.

During registration we will collect your details and these will be stored securely. We will only email you to confirm your registration details or when you specifically ask us to (for example to receive a password reminder), or if we need to contact your regarding an advertisement you have placed on the site. We will not disclose, sell or pass on your information to any third parties. These details are available to you at any time and you have the option to amend them through the user menu screens.

When you place an advertisement on the site any potential buyers who request more information by clicking on your advert will see a link click here to contact this advertiser . This will allow them to send an email to the email address you used when you registered, via a pop-up form. Your email address will not be displayed on the site.
